Course Description
The course aims to foster a critical appraisal of legal and regulatory issues facing maritime transportation. Key topics include carriage of goods by sea, maritime safety and liability, and marine insurance. Relevant international legal instruments, specific national legislation and cases will be comparatively studied. The issues examined include international sales and incoterms, carriage contracts and bill of lading, cargo claims and carriers’ liability, general average and limitation of liability, charter parties, maritime safety, security and navigation, salvage and towage, multimodal transportation and marine insurance. The role of admiralty courts and maritime arbitration and emerging legal issues will be briefly introduced.
Intended Learning Outcomes
CILO-1: Students will be able to identify major legal issues, norms and regulatory standards facing international maritime transportation.
CILO-2: Students will be able to clarify incoterms, maritime transportation and the role and significance of bill of lading in the context of documentary credits.
CILO-3: Students will be able to determine key legal issues arising in shipping claims and carrier liabilities based on the norms governing carriage and other shipping contracts.
CILO-4: Students will be able to describe fundamental law and regulatory standards in maritime safety and security and other maritime operations like salvage and towage, and to synthesize the risks in maritime transportation and the legal standards of marine insurance, especially in multimodal transportation, and to indicate the role of courts and arbitration in resolution of maritime claims and disputes.
